The present privacy policy (referred to below as the “Policy”) is authored and published by Planify, a venture of Coteries SA, a company incorporated in Switzerland (hereafter “Planify”). The purpose of this privacy policy is to provide clear notice about personal and other information collected through your interactions with Planify applications (“Applications”) or website (“Website”) and the related services (“Services”), features, content or websites about how and why Planify obtains, stores and processes data and information, such as name, address, e-mail address, profile pictures, phone numbers, credit card information (the “Data”), as well as through correspondence with Planify, which can identify the users and that the users may send us while accessing the Application or the Services.

The intended audience of our Websites does not include children; therefore, we do not knowingly capture personal data from children. By accessing Planify’s Applications/Services, users unequivocally consent to the Data collection and use practices described in this Policy. Data are collected from you:

In addition, we may collect your IP address and use Google Analytics in our Applications to collect anonymous information about visitors’ behavior. We use the Google Analytics service. The tool collects information allowing us to understand the interactions with our website, to refine this experience by improving the site but also and especially to better understand our visitors (you!). For example :

Please note that this is not personal information in the true sense of the word. At no time do we have your email address, your name, your age, your address, etc.

At best (with your consent), we have estimates of age ranges, geographical distributions, types of devices used, a measure of actions carried out on our site (beyond simply the pages consulted). We can for example know if you have viewed a video, downloaded a document, clicked on a specific link, etc. But again, we will know it in aggregate, never personally.

3. Use of Data

We collect Data about users so that Planify can grant you access to Planify software, personalize your use of the Applications/Services, assist your use of the Applications/Services and improve the Applications/Services generally. We may collect and use Data to invoice our products or services, to inform you about events, announcements, products or services you request, to market products and services, or to communicate with you for other purposes, such as compliant processing. In particular, depending on your selections for our Data protection questions we may arrange for you to be sent information about related products and services from us and carefully related third parties (see section 5). You may update the answers to your questions at any time.

In addition, we may use your Data to improve our services for our own internal statistical and operational purposes, to evaluate customer interests as well as purchasing and other trends among customer,s and to better determine product development, marketing strategies and customer services. Please note that we expressly reserve the right to verify the accuracy of your Data, in particular concerning your contact details (postal address, email, phone, etc), your financial information and the purchase of our products or use of our services. By submitting your Data, you expressly consent to such use and verification.

Note however that most of the information we collect from our Applications/Services is anonymous information (such as browser type, operating systems and the date and time of access), which we may process to improve the content of our Applications/Services and to learn more about our visitors’ behavior. In doing so, we may use tracking technology (such as cookies).

4. Transfer

Data may occasionally be transferred to third parties who act for or on behalf of Planify, for further processing by the purposes for which your Data were originally collected. When disclosure of Data to such third parties is likely or necessary for whatever reason, we endeavour to ensure that such third parties provide an adequate level of protection regarding the Data and will contractually require them to process Data transferred only for the purposes authorized by you and on a confidential and secured basis.

5. Non-Disclosure of Information / No spamming

Unless otherwise expressly provided for in this Agreement, Planify shall not sell, rent, share or otherwise distribute or make available your Data to third parties, except when;

  • you breach this Policy or the Terms of Use (https://planify.io/Terms-of-use)
  • required to do so by law or by any Governmental body;
  • it is necessary to enable Planify to perform services requested by you.

Planify does not conduct “spamming”. Spamming is defined as sending unsolicited e-mails, usually of commercial nature, in large numbers and repeatedly to individuals with whom the sender has had no previous contact or who have not given his consent to receive such communications.

6. Security / Confidentiality

Keeping your information secure is very important to us and most sections of the Applications/Services may encrypt Data using SSL or a comparable standard. To enhance the security and confidentiality of Data that we collect online, we use data networks protected, inter alia, by industry standard firewalls and password protection. We undertake to take all reasonable steps in order not to allow your Data to be accessed by third parties other than those authorized under this Policy.

However, please be aware that the Internet is generally not a secure environment and no data transmission over the Internet can be guaranteed to be totally secure.

Although we strive to protect your personal information, we cannot guarantee the confidentiality of the Data provided by you or material transmitted via our Applications/Services or by e-mail. Thus, we cannot be responsible or liable for the security of your Data whilst in transit via the Internet.

7. Accessing and updating your personal information

You have the right to access and update your Data or to require their deletion at any time, by sending an email to support@planify.io. As a result of such deletion, please however take note that you may not be in a position anymore to enjoy all or part of the functionalities of the Application/Services.

8. Data Transfer Abroad

We may maintain databases in different jurisdictions. We may transfer your Data to one of our databases located outside of Switzerland, namely Ireland or Germany. If the level of privacy protection in such a country was not adequate, we would ensure that Data transferred to our databases in that country are nevertheless adequately protected, be it to companies that have adhered to the safe harbor principles or to the EU standard model clause. By submitting your Data to our Applications/Services, you expressly agree to its possible transfer to, and storage in, such databases.

9. Links to other websites

As a service to our visitors/users, our Applications/Services may provide content and links to other websites that are not operated or controlled by Planify. Therefore, Planify cannot be responsible or liable for the content of such websites or the privacy practices of such other parties. We encourage you to review and understand the privacy policies applied by such third parties before providing them with personal information.

10. Applicable Law / Forum

THIS POLICY AS WELL AS YOUR ACCESS TO OUR WEBSITE, APPLICATIONS AND SERVICES IS SUBJECT TO AND GOVERNED BY SWISS LAW WITHOUT GIVING EFFECT TO CONFLICTS OF LAW PRINCIPLES THEREOF. ANY DISPUTE REGARDING THIS POLICY OR OUR HANDLING OF YOUR DATA IS SUBJECT TO THE EXCLUSIVE JURISDICTION OF THE ORDINARY COURTS OF THE CANTON OF BERN, SWITZERLAND, WITH THE EXCEPTION OF AN APPEAL TO THE SWISS FEDERAL COURT.
